The rule of law is the most important political ideal today, yet there is much confusion about what it means and how it works. This 2004 book explores the history, politics, and theory surrounding the rule of law ideal, beginning with classical Greek and Roman ideas, elaborating on medieval contributions to the rule of law, and articulating the role played by the rule of law in liberal theory and liberal political systems. The author outlines the concerns of Western conservatives about the decline of the rule of law and suggests reasons why the radical Left have promoted this decline. Two basic theoretical streams of the rule of law are then presented, with an examination of the strengths and weaknesses of each. The book examines the rule of law on a global level, and concludes by answering the question of whether the rule of law is a universal human good.

简单、清晰、明确。中文译本也不错,只是犯了几个不必要的小错误,可能是没有仔细校对。
绕了很大的圈子,最终还是回到形式法治的概念(限制主权、形式的合法标志、rule of law,not man),再加上需要信仰和接受。说实话看得很没感觉。但如果真如此,中国的法治之路太难太难
并非形式法治。最后一页已然明示:“the idea that the rule of law is a moral good without respect to this underpinning(moral content)...should be rejected by us”。其实他所称的不必然包含在法治观念中的democracy,individual rights & justice可从其所说的法治三大主题即government limited by law, legal fomality& rule by law,not man推衍出来。为使自己的三元理论具普遍意义,作者尽量避免道德判断参与概念讨论,但前述明暗三元论及后对tradition的反复强调已然隐晦地表达了自己的价值判断
希腊思想为法治提供理想模型与灵感来源,中世纪引入更现世的资源:世俗权力与教皇的斗争、德意志习惯法与《大宪章》。 伴随资产阶级力量的崛起,作为资产阶级核心纲领的自由主义进入法律,并形构当代法治的基本蓝图:个人自由——与其建立一个共享价值的社群,毋宁追求个体间多元价值的彼此尊重。当然,尽管在传统的自由主义中,法律被视为潜在的自由威胁——自由在法律沉默之处存在,但当代自由社会的“法律化”已成为基本事实。 当代的法治,在哈耶克的定义内,应当是普遍、平等且确定的法所形成的系统:政府行为受确定且事先公布的法律所限制,政府在特定情形下如何行使强制权力、乃至于规划个人生活的方式公平且确定。民主本身并不必然产生道德良善之法,形式法治与实质法治的内在要求仍然以政府受法律制约、形式合法性与法治而非人治为基本要求。
很难想象我居然把Tamanaha论rule of law的文献都过完了…
太适合我们这种门外汉看了。印象比较深的是里面提到为什么judges should render their decisions based exclusively on the law,而不是根据像legal realists所强调的经济后果社会影响什么的,因为这就是rule of judge而不是rule of law了啊。大部分学者都比较赞同formal legality,而不是expect more from the rule of law还是很有道理的。
