六百页的砖头已粗略扫完,读书笔记后补。该书堪称是宪法解读originalism的实用手册,一条一条canon下来,大概是集古今大全,把textualist对在法律诠释的所遇到的问题的对策都归纳总结起来了,scalia都这把年纪这般资历了,还孜孜不倦写这种纯学理探究的厚砖头(貌似也是现今唯一的一位),书中的字里行间处处流露着我最喜欢他的那种霸气,仿佛在对那些有不同观点的人说:“不服来辩啊!!!”
为什么国内没有Reading Law的译本呢😢应该算是比较重要的著作了吧
我明白大法官的基本观点,要严格遵从宪法条文,不能为了某一个目的而解释宪法并赋予其新的意思,然而我并不认同这个观点。司法权当然不是立法权,但是当法律滞后的时候难道要一味地出台新的修正案吗,只要按照时代精神合理并严格解读我认为大法官还是能释法的,但的确要警惕目的主义。
